Rejection-Free Instant Prospecting Techniques You’ll LOVE

How great and stressless life would be? How fun would it be to make your team grow fast with only qualified, motivated and really-willing-to-be-serious-about-the-business prospects? Well, these techniques do exist. So, here is an example that works LIKE CRAZY.
This is the "$15.000 Pay Raise Test" story. You meet someone. After a while, both of you start to talk about the family, the work, etc.
Here is what you can say:
YOU: "Hey, by the way… Have you ever wanted to be wealthy enough to retire and stop committing to work every day?"
THE OTHER: "Well… Yeah, I've been dreaming about that for years, but you know, I'm just average so I guess I should forget about this kind of dreams…"
YOU: "I've been told about a '$15.000 Pay Raise Test', wanna see if you can pass it?"
OTHER: "The $15.000 Pay Raise Test!? Oh well… Why not? Go ahead!"
YOU: "Imagine being at your work. The boss comes at your desk and ask you if you would agree to have a pay raise. What would you say?"
OTHER: "That will NEVER happen! But of course I would say yes…"
YOU: "Great! Here is your boss idea: all you have to do is attend a training 3 times a week. It would last something like 10 hours a week and it's a 12 month training. Your boss says that you would have to pay a $500 fee for the whole 12 month training but if you graduate, he would offer you a neat $5.000 per year raise starting next year because you would be more skillfull than your colleagues. What would you say?"
Here is where magic happens: what you just described is an 'average start in MLM' but with words and situations easy to rely to for any worker. If the person you're talking to answers 'NO I wouldn't accept', you're not facing a good prospect and you can say the test is over. Your prospecting is done; you have your answer. The best part is that your prospect doesn't even know you've just been prospecting him! If he says 'Yes, for a $5.000 per year pay raise I would do it', then you're facing a pre-qualified prospect.
But now, you have to check if he would be seduced by the MLM concept. Here's how to do that:
YOU: "Excellent! The Pay Raise Test is almost finished and you're doing great. So, now you would say 'yes' this means that you would attend this training 3 times a week during a year. After that, your boss would give you the $5.000 per year raise. But you're not finished yet. After you graduate, the boss comes to you again, and here he goes: "now you've complete the training, I would like to know if you would agree to teach what you learned to 5 co-workers. This means you would have to train them 3 evenings per week for 12 month, just like you did the past 12 month. When they graduate thanks to your teaching, I would offer you ANOTHER $5.000 per year pay raise." So, what would you answer?"
THE OTHER: "Gee! I would say YESSSS!"
YOU: "Excellent! Here is now the last part of the test: your boss asks you if you would accept to train your 5 'students' next year to be able to teach the exact same training to 5 co-workers each. If you say yes, it would take you 3 evenings per week for 12 month but you would receive ANOTHER $5.000 per year pay raise. This means you would have added $15.000 to your yearly income in 3 years only. What would you do?"
THE OTHER: "Gosh! I would do it! $15.000 extra per year is huge!"
At this stage, you know you're facing a highly qualified and motivated prospect who felt in love with network marketing without even knowing it. What do you want to do next? Well… It's up to you: you can offer your friend a prospecting book to read, a CD, a flyer or you can invite him to meet that 'mysterious' guy who specialized into helping average people to create above average income without asking their boss…
From all the previous alternatives, let me explain you why the last one is my favorite. When you invite your prospect to meet with one of your upline sponsors, you instantly prove him that MLM is a TEAM business. If you can invite one of your upline sponsors to help you, your prospect will rapidly understand that he would also be authorized to do the same.
And, last but not least, you would be using a great success principle: "The stranger is the expert". Even if your upline sponsor is in the business for a couple of week, he will have much more credibility into your prospect eyes than yourself. And since you want your offer to have the most possible credibility, you want your upline sponsors to come along with you to explain what is MLM to your prospect.

Fortune High Tech Marketing Class Action Law Suit

Fortune High Tech Marketing (FHTM) is based in Lexington, Kentucky, and was founded in 2001 by Paul Orberson.
FHTM offers products, services and opportunity to people across the United States as well as in Canada, the United Kingdom and Puerto Rico.
FHTM is a pending member of the Direct Selling Asociation.
FHTM offers a wide range of products and services for Independent Representatives to market to their customers, from the True Essentials line of health products to Dish Network’s television service to The Wireless Shop’s selection of name brand providers.
Kevin Thompson the MLM Attorney:
It was bound to happen at some point. Unlike the last lawsuit I posted about Fortune High Tech Marketing (which turned out to be a hoax), the below class action lawsuit against FHTM is legit.
I pulled it off of Pacer, which is where American court documents are made publicly available.
The complaint is long but the allegations are simple:
1) Fortune is allegedly a pyramid because:
a) Sales Culture: The sales culture focuses predominantly on recruitment over selling. An accomplished sales rep in FHTM was quoted as saying: “We’re not looking to sell you something; we’re looking for team members.” The lawsuit is basically alleging that the field completely disregards selling and that the recruitment culture is standard behavior in the FHTM organization, which leads to serious misrepresentation.
b) Pay plan does not lead to true external sales: There are no real incentives in the pay plan for selling to nonparticipants. Allegedly, the reps are required to accrue 3 customer points before they climb the ranks; however, those points are accrued by the reps themselves….one point is gained by simply paying for access to the company’s website for back office support.
c) Commissions from Training fees!: I just wrote about this last week about why it’s a bad idea to pay commissions on sales aids. The lawsuit alleges that FHTM pays commissions when “certified trainers” train their downline managers (after the downline managers pay a $200 fee). Since the training fee has no relevance for nonparticipants, the plaintiffs are arguing that this is mainly a clever transfer of money from new investors to older ones, which is illegal.
I cannot predict if the allegations will prove true or not because I know very little about the FHTM model; however, it seems like the complaint focuses squarely on the FHTM policies and the pay plan, which means there’s not much wiggle room for FHTM. It will be hard for them to defend their practice of paying commissions on training fees, which I think is their largest problem.
FHTM reps habitually say “we have former state attorney generals on our legal team.” Allow me to address this point: simply because a company has hired “former AGs” as their attorneys, it does not mean that those AGs understand the industry. AGs have countless responsibilities and they might not understand the nuances in MLM law. I’m not saying FHTM’s lawyers are incompetent.
I am saying that if there’s any truth to these allegations, any attorney with knowledge of this field would have either gotten FHTM on the right track a long time ago or would have withdrawn his or her representation. If the former AGs were recently hired, it’s a different story (clearly they lacked the time to clean up the house). However, if they’ve been on board for several years….it’s not good.
Monavie German Backoffice Revealed
A German Ruby Monavie distributor has shared his backoffice through Facebook with the world. A brave but maybe a not-so-smart move, I guess the Monavie corporate guys would not like that, as it gives an interesting look into the kitchen of a launch in a new market Germany. What does it say?


In this Binary downline there are 733 sign ups, 385 links and 348 rechts, a nice balance. The volume in both legs 6,875 and 6,650 points. 1 case Monavie, 4 bottles (1 month supply) counts for 100 points, therefore the retention rate (Distributors/ monthly autoships) is > 75%, which is very high.
Never ever share as a distributor your backoffice with the world unless you like to be terminated, it is company confidential information…..

Monavie Leader Darrell Utterbach passed away

Dear MonaVie Family,
It is with profound sadness that I communicate to you the passing of Darrell Utterbach, Royal Black Diamond distributor, MonaVie Distributor Advisory Board member, loving family man, and dear friend and colleague. Darrell passed away unexpectedly last night (MST) while conducting business in Seoul, Korea.
For more than two decades, Darrell has been a proponent of and respected voice for the entire Direct Selling Industry. Had it not been for Darrell visiting my home in 2004 and introducing me, Randy Larsen, and Henry Marsh to the acai berry, there likely wouldn’t be a MonaVie today. We owe him a great debt of gratitude.
On behalf of the entire MonaVie family, Karree and I offer our deepest condolences at this time of great loss to Tracy, Darrell’s beloved wife. His unexpected and sudden passing should be a reminder to each of us that life is precious, and that we should strive to live our lives with deeper meaning, each and every day. We are mindful of the Utterbachs’ distributor organization at this time as well, and pledge to them our continued support. On a housekeeping note, I would ask that we all please respect the privacy of the Utterbach family at this critical time.

It is with great sadness that we announce today that we must cease the direct sales multi-level marketing business of eFusjon, Inc. as of September 1, 2010.
The independent contractor distributor agreements will terminate as of this date.See Distributor Agreement, Section 7 (“The Agreement shall continue in effect between the parties hereto until either party terminates the Agreement…”).Qualified distributors will receive their last compensation check for the month of August, less offsets against any amounts that are owed to the Company, on September 10th. Any commissions due will be available in your “Hyperwallet” account until October 31, 2010, after which date you will need to contact the corporate office (to access your “Hyperwallet” account.

This was a very difficult decision for the Company and not one we had hoped to make. When the owners started eFusjon in 2008, we envisioned a unique and successful MLM business with healthy and unparalleled beverage products. The goal was to market these products through independent distributors via the MLM direct sales business model. Distributor performance, however, has been steadily declining for over a year now, and as a result, so has the Company’s revenues. The Company can no longer maintain a marketing model that is not generating the funds needed to grow a viable business. Iran prohibits Oriflame

Authorities in Iran have prohibited Oriflame’s business activities in their country and arrested three executives among which there is thought to be a Swedish citizen. The Iranian Oriflame office in Tehran was closed on Sunday August 22 2010. The three people were arrested without being given a specific reason so that Oriflame is not in the position to provide any information on the background of the authority’s decision.
Swedish television has reported on the arrests and on the business’s prohibition nevertheless, at this stage the information is only based on speculations. According to Oriflame’s head of finance Gabriel Bennet the company certainly wants to continue business in Iran. This is in fact of great interest to Oriflame as since 2007 around one fifth of the Asian market’s turnover was generated in Iran. The cosmetics business is particularly worthwhile in Iran. Every year this market segment in Iran generates a turnover of approximately 2 Billion Dollars – where only Saudi Arabia is stronger within this region. Oriflame was founded in 1967 and is meanwhile conducting.

Indian actress Malika Arora Khan is an ambassador for the Oriflame range in Asia and the Middle EastIranian authorities have closed the Tehran operations of Oriflame Cosmetics and detained five workers, the Swedish firm has said. The reasons for the move were disputed, with Tehran alleging fraud and Oriflame saying the authorities disliked it employing women in certain roles.
Last week, Iran's commerce and culture ministries called the company illegal and blocked its local internet site. Oriflame said the move could be because it employs women as sales consultants.
According to a statement on the company's website on Monday, "business conditions in Iran have deteriorated in recent months".The statement continued: "The authorities have now closed operations in Tehran. The authorities have also detained three members of staff and two sales consultants without disclosed reasons.
"Oriflame has not at present access to detailed information relating to the background to, or effects of, the current situation." In Tehran, state radio reported that the company had violated tax regulations and custom law, and operated an illegal marketing scheme.
An Iranian newspaper, Kayhan, accused the company of supporting opposition members in Iran.
In an interview with the Associated Press news agency, Oriflame's chief financial officer, Gabriel Bennet, rejected the allegations. "Of course this is not true. We are running a business in Iran like anywhere else in the world, according to good international code of conduct," he said.

Xango Juice Forbidden in Germany

As XanGo produced their product using the fruit rind, an ingredient so far lacking any significant consumption in the markets of the European Union, it would be necessary to provide the European Commission with comprehensive scientific studies regarding the safety of the product.
These studies would then have to be reviewed by the European Food Safety Authority (EFSA). It is only upon receipt of the official approval as a Novel Food that the distribution of XanGo® Juice would be legal. As XanGo lacks the authorisation required for Novel Foods, the distribution of the product has now been (retroactively) prohibited through a final judgement by the Munich Regional Appeal Court (Oberlandesgericht München).
(Source: ZLR-Food Law Journal- booklet 4/210, p. 474 – 493.) According to our sources, XanGo even referred this legal dispute to the German Federal High Court of Justice for a decision. However, XanGo withdrew the request after the oral proceedings – presumably in order to avoid another defeat. As to the consequences of this decision with regards to the distribution of this company within Europe, one may only speculate. What is certain, however, is that the German market will remain inaccessible for XanGo Juice for years to come.

The German District Court in Frankfurt am Main has important parts of the Monavie Marketing Plan forbidden in Germany by its decision of 24.08.2010.
It's also a decision against two MonaVie distributors in a earlier case. The decision seems to be even so strong that German Monavie distributors could get up to 2 years in prison, if recruitment will go on.

The case has been filled by the Hamburger law firm Schulenberg & Schenk who are MLM lawyers. Schulenberg and Schenk are publishing on a regular basis in the German MLM magazine Netcoo according to their website.
A reason for this temporary injunction according Schulenberg website is a non-compliance on parts in Monavie's marketing plan for the German law on "Progressive Kundenwerbung" (§ 16 Abs. 2 UWG) which can be translated in english as Pyramid selling.

Dutch Supreme Court: MLM, No Income Tax in the Netherlands…

The Dutch Supreme court verdict in an important MLM Tax Case:
"The Dutch Supreme Court concludes that the possibility of a participant (so a MLM distributor) to acquire royalties so much depends in general on unpredictable factors, which the distributor can not influence, that any positive result of such participation (MLM) speculative is". The Supreme Court affirms the ruling of a lower court.
I do not agree with the Dutch Supreme court, a distributor would not be able to influence it's MLM income, but who cares if you do not have to pay tax?
Personal MLM Retail profit is still under the Dutch Tax law as that could be influenced as concluded by the court, however for most distributors retailprofit is only a very small part of the cake. Suppose you have excellent MLM earnings in the USA or in Europe and your company is willing to pay you through the Netherlands, it might be a very nice move…..

Is Amway a great opportunity for a starter?

Suppose your are enthousiastic about Direct Selling, you have 8 hours a week to spend as a start, you have a big contact list and you are considering to join Amway, the grand old lady of network marketing. What are the pro's and what are the con's?
Amway shows a stable growth, in 2007 an estimated $7,100 million in 2008 $8,200 million in 2009 $8,400.
In the Business for Home.org Top Earners rankings there are approx. 87 Top Earners identified. Very low numbers compared to other companies, however Amway is a company who is closed to the outside world and there must be more top earners around.
In Western Europe Amway has not build up significant downlines, the USA and Asia are the main markets. Amway has signed up international soccer star Ronaldinho as a spokesman for its Nutrilite brand of vitamins, minerals and dietary supplements and put great efforts in it's marketing.
It seems the Amway pay plan is on of the most confusing plans in the MLM world. Products are outstanding, and you will get your money if you qualify without doubt. No legal issue's around Amway, it is a stable and strong company. However if you look to the top earners, you discover hardly any younger guys and girls.

Monavie letter to Ted Nuyten regarding the Reported Revenue for 2010

I received the below letter from Monavie's Legal Counsel– Graden Jackson from Strong Hanni Law Firm-, to pull down the post Monavie Revenue 2010 under heavy pressure? Mr. Jackson informed me that the post was malicious and alleged that the post was published with the intent of interfering with MonaVie’s business relationships with its distributors.
I think it’s obvious to say that this website regularly publishes information about the Direct Selling Industry. On this website, we share the good news and the bad news. Just recently, I published about the top earners in the network marketing industry.
4 of the top 25 earners were from MonaVie. Clearly, I do not have a grudge to settle with MonaVie. When I receive newsworthy material, I publish it assuming that it appears accurate. In this particular case, I got the information from this website. Based on my observations in the industry, the information seemed accurate. Rod Cook, the MLM watchdog, recently published an article about MonaVie’s decline in numbers.
In my previous post titled, “Monavie Revenue 2010 under heavy pressure?” I have made it crystal clear that the figures are from an unverified source and I have made a disclaimer on the information. Unlike was Mr. Jackson alleged, I did not publish the article with “malicious intent” and I did not publish the article with the hopes of “interfering” with MonaVie’s business.
I have absolutely nothing to gain by harming MonaVie. In fact, I have published articles in the past that have been positive towards MonaVie. If the statistics are true and MonaVie is in a steep decline, it’s certainly newsworthy.
Instead of threatening me with a legal action and using words like “malice” and “tortious,” the more appropriate and civil response would have been to reach out to me and provide the correct figures. Instead, they’ve chosen to attack my character without even providing any data that would suggest the numbers are incorrect.
As a Dutch web reporter, I am provided with broad protections under the Dutch constitution to publish newsworthy information. And in the USA, one of the principles that makes it such a great nation is the broad protection afforded to speech.
I am not defaming MonaVie and I would never “maliciously” attack any company. Furthermore, I never said MonaVie was not a viable business as suggested by Mr. Jackson. If Mr. Jackson interprets a significant drop in revenue as proof of non-viability, it was his own conclusion and not mine.
I will only agree to delete the post if MonaVie provides me with accurate figures or they at least make a public representation that the figures are substantially wrong with “substantial” being defined as off by more than 5%. As requested by Mr. Jackson, I am to write on this blog that the figures are “inaccurate” and “unsupported by facts.”
How do they expect me to make this representation when they are unwilling to provide with any data to contract the publication? Instead, in the spirit of cooperation, I will extend an invitation to MonaVie and allow them to publish a statement on my own site. I have no malicious motive towards MonaVie and I am pulling for their success. They’re one of the larger companies in the network marketing industries and their success is certainly admirable.
I would love to have the opinion of our readers. Am I missing something here or should I just pull it down?
Mannatech Revenue down 25% in Q2 2010 to $57 million
Mannatech Inc. (NASDAQ: MTEX) reported a net loss for its second quarter (2Q10), ended June 30; the net loss of $3.8 million was a positive step from $5.5 million lost in the comparable 2009 period.
Similarly, Mannatech’s operating loss of $2.1 million for 2Q10 moved in the right direction from the $11.1 million loss for 2Q09.
However, the $57.6 million in net sales for 2Q10 was down 25.8 % from the $77.6 million reported for 2Q09; driving the downward trend was a decline of 32 percent in North American sales for 2Q10 compared to the comparable period in 2009. Mannatech noted sales were considerably higher in 2Q09 because of the launch of a lower price pack promotion, yet accompanied by higher commission costs.
MLM in Nederland groeit sterk
Multi Level Marketing (MLM) of Netwerk marketing is een business model waarbij produkten of services met behulp van een netwerk van distributeurs rechtstreeks naar de consument wordt gebracht. MLM is aan een sterke opmars bezig zowel in Nederland als wereldwijd. Netwerkmarketing is een vorm van directe verkoop.
Toch zijn er duidelijke verschillen aan te wijzen tussen directe verkoop en netwerkmarketing. Bij directe verkoop ligt de nadruk op de verkoop van producten. Niet iedereen kan zomaar verkoper worden. Daar gaat vaak een selectie en opleiding aan vooraf. Bij netwerkmarketing ligt de nadruk op het bouwen van een netwerk op basis van het gebruik van producten. In principe kan iedereen die dat wil hiervoor inschrijven omdat er geen echte selectie plaats vindt. MLM zorgt voor ongeveer de helft van de omzet van directe verkoop.
Wereldwijd zijn de bedrijven voor directe verkoop verenigd in de WFDSA (World Federation of Direct Selling Associations. In Europa kennen we de FEDSA (Federation of European Direct Selling Associations) en voor Nederland de Vereniging Directe Verkoop. Deze organisaties houden zich voornamelijk bezig met regelgeving, met educatie en communicatie, met consumenten bescherming en met de ethiek van deze bedrijfstak.
In de jaren 80 heeft Amway het model geintroduceerd in Nederland, waarna grote bedrijven als NSA – Juice Plus+, Herbalife, Nu-Skin, Vemma en Oriflame volgden alsmede een aantal kleinere netwerk marketing bedrijven. In Nederland zijn circa 50.000 mensen actief in de branche. Het doel van netwerkmarketing is om producten bij eindgebruikers te krijgen en de basisregel bij MLM is simpel: Geen Omzet = Geen Beloning.
In het 2e kwaartaal van 2010 groeide de omzet van een aantal toonaangevend MLM bedrijven tot 20%.

MLM Companies show strong growth in Q2 2010
Herbalife (USA) reported for Q2 2010, a surge in profit for the second quarter as sales increased 19,9% across almost all geographies.
Revenues for the quarter grew 20.5% to $688.80 million from $571.80 million in the year-ago quarter. Revenue growth reflected a 19.9% increase in volume and 11.9% rise in Average Active Sales Leaders.

Nu Skin (USA) announced record quarterly results, with revenue of $388.4 million for the second quarter, a 20% improvement over the prior-year period of $334 million
"The introduction of our breakthrough ageLOC skin care system has been a huge success around the world, generating $150 million of revenue in the past three quarters," said Truman Hunt, president and chief executive officer. "We continue to build tremendous energy within our distributor force, as demonstrated by a 15 percent quarterly growth rate in executive distributors. In addition, our continued focus on operational efficiency resulted in a record 15.2 percent operating margin for the quarter, evidence of our ability to leverage revenue growth to improve profitability."

Vemma Nutrition Company (USA), specializing in premium liquid nutrition reports a growth of 25% in revenue, year over year.

Pre-Paid Legal (USA) new sales associates enrolled increased during the 2nd quarter of 2010, 44.3% to 36,313 from the 25,172 enrolled in the 2nd quarter of 2009. Revenue in Q2 $113 million.
New memberships produced increased 2.6% to 125,417 during the 2010 quarter compared to 122,230 for the 2009 quarter.

Business For Home.org received information about MonaVie's revenue from an anonymous source. We guess it is an insider / employee who is for some reason not happy with the company. It gives our readers an interesting view in the "Monavie kitchen". Keep in mind that we make a BIG DISCLAIMER on this, the information can be reliable, or not. You decide….
Monavie does not publish updated actual distributor earnings anymore (Last one is from 2008-2009) which is not a good sign. Therefore this figures could be reliable and could be the 4 weeks revenue from somewhere around February – April 2010. More reports are coming in that Monavie's revenue is under heavy pressure.
In 2009 Monavie's revenue has been around $785 million, based on this figures 2010 revenue will be around $600 million a 20% – 25 % decline. The USA is the Nr. 1 market with 76 %, followed by Japan 9%, Canada 8%, and Australia 2%. Japan is growing fast. The decline in revenue for the USA is shocking…

YTB Faces A Class Action
Embattled YTB International faces another legal challenge from a group of multi-state plaintiffs who filed a putative class action lawsuit against the company and its officers, charging the company is operating an illegal pyramid scheme.The plaintiffs, who are from Illinois, Missouri, Georgia and Utah, allege that Wood River, IL-based YTB International is a scam that offers no direct selling opportunity but instead is a never-ending recruitment scheme.

The complaint was filed June 10 in Madison County Illinois Circuit Court. The plaintiffs allege that the YTB program is based on selling cheap online travel agencies to recruits then encouraging them to recruit others while requiring certain levels of monthly services and, therefore, is a fraud.
In a nine-count complaint, the plaintiffs are seeking actual and punitive damages of more than $900,000, plus an order prohibiting the defendants from continuing in their conduct and other relief the court decides on.
YTB has faced legal challenges from the Attorneys General of California and Illinois as well as earlier class action lawsuits. YTB settled the California case while the action by the Illinois attorney general is pending. Other class actions filed against YTB by private plaintiffs were dismissed.

Direct Selling Secrets ARPU
Do you know the ARPU in your company or downline?
What is ARPU?
ARPU stands for Average Revenue Per User / Distributor usually abbreviated to ARPU and is a measure used by networking companies. It is the total revenue per year divided by the number of distributors or users.
This provides TOP Earners a granular view at a per user basis and allows it to track revenue sources and growth. Around $1,000 is a Direct Selling standard. Below $1,000 you might have a problem.
If a Direct Selling companies disclose it's distributor numbers it might be inflated, therefore you better can take a close look to the ARPU.

Forever Living Products claims to have 9,5 million distributors however if you look to the ARPU it is only $316 per user per year. Suppose you have a downline of 1,000 guys and girls your annual revenue over that group would be $316,000. On an average 5% payout you could qualify for, you will earn $15,800. Nice, but not very exiting…
So you better can look for a higher ARPU, if we sort the same figures on the highest ARPU, Amway is king with an ARPU of $2,800 per year. 1,000 distributors will bring you $140,000 commission… However, maybe it is easier to build up a Forever Living Products downline then an Amway downline, but that is an other discussion…..
